Il lavoro analizza il contratto di mandato sportivo, che si configura come un contratto misto tra il diritto civile e l’ordinamento sportivo, e esplora la figura dell’agente sportivo sotto il profilo giuridico, economico e sociale.

Il primo capitolo descrive la nascita e l’evoluzione dell’agente sportivo, esaminando le sue origini e le normative che hanno contribuito alla sua professionalizzazione. Un’attenzione particolare è riservata alla deregulation introdotta dalla FIFA nel 2015, che ha semplificato l’ingresso nella professione, ma anche creato criticità legate alla qualità e competenza degli agenti. Successivamente, la riforma ha cercato di sanare questi difetti, implementando un sistema di abilitazione e registrazione degli agenti, per garantire una maggiore trasparenza e regolamentazione della professione.

Il secondo capitolo si concentra sull’analisi del contratto di mandato sportivo. Questo contratto è caratterizzato da una duplice natura: civilistica e sportiva, ed è fondamentale per definire i diritti e i doveri tra atleta, club e agente. Viene esplorato il concetto di rappresentanza e viene confrontatola figura dell’agente sportivo con quella di altre figure professionali disciplinate dal legislatore. Viene discusso l’impatto della legislazione sul contratto di mandato sportivo, che ha visto evoluzioni in termini di compatibilità con altre normative e professioni, come quella dell’avvocato.

Nel terzo capitolo, si analizza la disciplina e la regolamentazione degli agenti sportivi, con riferimento al sistema di abilitazione richiesto dal CONI e le problematiche legate alla responsabilità penale degli agenti. Si esamina anche il ruolo delle federazioni sportive nazionali, che devono seguire le direttive internazionali stabilite dalla FIFA e dalle normative europee.

Il quarto capitolo approfondisce le specifiche regolazioni per le diverse federazioni sportive italiane e analizza come ciascuna federazione regolato la figura degli agenti sportivi. L’attenzione è posta anche su come il sistema di regolamentazione debba bilanciare la libertà economica degli agenti con la protezione lavorativa degli atleti e sulle implicazioni giuridiche in caso di violazioni dei regolamenti.

La tesi evidenzia come la figura dell’agente sportivo si sia evoluta in un contesto sempre più normato, cercando di garantire una tutela maggiore per gli atleti e una professionalizzazione della categoria. La riforma del lavoro sportivo ha cercato di dare risposte concrete, ma si segnala ancora la necessità di un aggiornamento continuo della normativa per rispondere ai cambiamenti dinamici nel panorama sportivo e professionale.

The thesis focuses on the evolution of the sports agent figure in Italy, particularly examining the regulatory framework that governs the profession, with a focus on the CONI regulations and the specific regulations of various sports federations. The work analyzes the sports mandate contract, which is a mixed contract between civil law and the sports system, and explores the sports agent's role from legal, economic, and social perspectives.

The first chapter describes the birth and evolution of the sports agent, examining its origins and the regulations that contributed to its professionalization. Special attention is given to the deregulation introduced by FIFA in 2015, which simplified entry into the profession but also created challenges related to the quality and competence of agents. Subsequently, the reform sought to address these shortcomings by implementing an agent certification and registration system to ensure greater transparency and regulation of the profession.

The second chapter focuses on the analysis of the sports mandate contract. This contract is characterized by a dual nature: civil and sports-related, and is crucial for defining the rights and duties between the athlete, the club, and the agent. The concept of representation is explored, and the sports agent figure is compared to other professional figures regulated by the legislator. The impact of legislation on the sports mandate contract is discussed, particularly regarding its compatibility with other legal frameworks and professions, such as that of lawyers.

The third chapter analyzes the discipline and regulation of sports agents, with reference to the certification system required by CONI and the issues related to the criminal responsibility of agents. The role of national sports federations is also examined, as they must follow international directives established by FIFA and European regulations.

The fourth chapter delves into the specific regulations for various Italian sports federations and analyzes how each federation regulates the sports agent figure. The focus is also on how the regulatory system must balance the economic freedom of agents with the protection of athletes' employment rights and the legal implications in the case of regulatory violations.

The thesis highlights how the sports agent figure has evolved in an increasingly regulated context, striving to ensure greater protection for athletes and professionalization of the category. The reform of sports labor has sought to provide concrete answers, but there is still a need for continuous updates to the regulations to keep pace with the dynamic changes in the sports and professional landscape.
