La tesi analizza alcune delle più rilevanti decisioni recenti della Corte Suprema degli Stati Uniti, evidenziandone l’impatto costituzionale e politico. Nel primo capitolo vengono esaminate sentenze decise con maggioranza 6-3, che mostrano un netto allineamento ideologico tra i giudici. Queste decisioni, spesso di portata notevole, rappresentano un cambio di rotta rispetto alla giurisprudenza precedente e mettono in luce la crescente polarizzazione interna alla Corte. Il secondo capitolo è dedicato al diritto all’aborto negli Stati Uniti, con particolare attenzione alla sentenza Dobbs v. Jackson Women’s Health Organization (2022). La decisione, che ha ribaltato Roe v. Wade, ha dichiarato inesistente il diritto federale all’aborto, restituendo ai singoli Stati la possibilità di regolamentarlo. Viene ricostruito il percorso storico-giuridico del diritto e le motivazioni adottate dalla maggioranza. Nel terzo capitolo si analizzano le conseguenze federalistiche di tali pronunce: si osserva come il potere normativo si sia progressivamente spostato dal livello federale a quello statale, rafforzando le autonomie locali ma aumentando anche le disparità territoriali. La tesi mostra come queste decisioni abbiano riacceso il dibattito sul bilanciamento dei poteri e sull’unità costituzionale dell’ordinamento americano.

The thesis analyzes some of the most significant recent decisions of the Supreme Court of the United States, highlighting their constitutional and political impact. The first chapter examines rulings decided by a 6–3 majority, which reveal a clear ideological alignment among the justices. These decisions, often of considerable magnitude, represent a turning point compared to previous case law and underscore the growing internal polarization within the Court. The second chapter focuses on the right to abortion in the United States, with particular attention to the 2022 decision Dobbs v. Jackson Women’s Health Organization. This ruling, which overturned Roe v. Wade, declared that no federal right to abortion exists, returning to individual states the authority to regulate the matter. The chapter reconstructs the historical and legal development of abortion rights and analyzes the reasoning adopted by the majority. The third chapter explores the federalist consequences of these decisions: it observes how regulatory power has progressively shifted from the federal level to the state level, strengthening local autonomy but also increasing territorial disparities. The thesis shows how these rulings have reignited the debate on the balance of powers and the constitutional unity of the American legal system.
