Negli ultimi decenni lo sport ha assunto un ruolo di rilievo come fenomeno sociale, economico e giuridico, dando origine a un corpus normativo specifico: il diritto sportivo. L’elaborato analizza l’evoluzione di questa disciplina in Italia, con particolare attenzione al riconoscimento giuridico del lavoro sportivo e alle sue forme di tutela. La riforma introdotta dal D.lgs. 36/2021 ha rappresentato un momento di svolta, superando l’idea di un diritto sportivo totalmente autonomo e riconoscendo l’influenza dei principi civilistici, nonché il valore educativo e sociale dello sport e la parità di genere nel lavoro sportivo. La tesi approfondisce inoltre la figura del lavoratore sportivo, le diverse tipologie contrattuali, la dimensione economica legata allo sfruttamento dell’immagine e l’assetto della giustizia sportiva, sistema autonomo ma coordinato con quello statale. L’obiettivo è offrire una visione d’insieme del diritto sportivo contemporaneo, evidenziandone la complessità, le criticità e le prospettive evolutive in un contesto giuridico in costante trasformazione.

In recent decades, sport has assumed a prominent role as a social, economic, and legal phenomenon, giving rise to a specific body of law: sports law. This paper analyzes the evolution of this discipline in Italy, focusing on the legal recognition of sports work and its protections. The reform introduced by Legislative Decree no. 36/2021 marked a turning point, overcoming the idea of a fully autonomous sports law and acknowledging the influence of civil law principles, as well as the educational and social value of sport and gender equality in sports employment. The thesis also examines the figure of the sports worker, various contractual arrangements, the economic dimension related to image exploitation, and the structure of sports justice, an autonomous system coordinated with the state judiciary. The aim is to provide a comprehensive overview of contemporary sports law, highlighting its complexity, challenges, and future prospects in a constantly evolving legal context.
