Riassunto (Inglese)
The widespread implementation of algorithmic technologies in the workplace is profoundly changing work organisation and working conditions, posing new regulatory and practical challenges. This contribution evaluates the extent to which the European Union existing law is capable of addressing these challenges and identifies the main regulatory gaps that emerge in the governance of algorithmic management. Chapter 1 lays the conceptual foundations and explores how algorithmic practices transform the exercise of managerial authority and therefore reshape the employment relationship. Chapter 2 critically assesses the principal EU instruments applicable to algorithmic management, focusing on the General Data Protection Regulation (GDPR) and the Artificial Intelligence Act (AIA), exploring both their relevance and their structural deficits. Finally, chapter 3, drawing on the promises contained in the recent Platform Work Directive (PWD), explores possible pathways towards a broader and more effective regulatory framework capable of properly addressing algorithmic management in the workplace.
