This study evaluates both the legal notion of human oversight according to European Union law, and its relevance in the field of human rights, fundamental freedoms and the rule of law, within the context of both preventing and combating crime, and the punishment of criminal offences via the administration of justice. This is a direct consequence of the increased use of artificial intelligence technology by law enforcement and judicial authorities at European Union level.
Consequently, this investigation intends to answer the question: Should European Union Law Recognise the Legal Notion of Human Oversight as a Due Process Guarantee in Artificial Intelligence-Assisted Criminal Proceedings?
Furthermore, it assesses the extent to which European Union law explicitly embeds the legal concept of human oversight in criminal proceedings and criminal procedural law at European Union level, as well as the paramount importance of its recognition by all of the people intervening in artificial intelligence-assisted criminal proceedings in accordance with its roles within the European Union.
