Riassunto
Regulatory anxiety in the United States of America has been the staple approach to effectively establish norms to rule on certain conducts or things. The European Union has been one key agent into pressuring this approach to the point that it might not be happening anymore, but rather the whole opposite in the Artificial Intelligence Regulation field. The explanation of this phenomenon can find its justification in the Brussels Effect (Both De jure and De facto) and how it has influenced the United States regulatory behaviour with other previous cases, which have triggered regulatory intentions in the US, but not quite the same strong effect that is already happening with the Artificial Intelligence Act of the European Union. There are still many more rules to come in the very near future, but as per now there is sufficient evidence to make some more accurate predictions about them, than what there were two years ago. These future rules may though change the panorama too, so this is a topic that demands continuous research during the rest of the decade. Documental research has taken place in this case, specifically on the content of rules on both “sides” and how this can be explained through the Brussels Effect results on a comparative analysis to determine whether the Regulatory Anxiety in the US has been overcome thanks to the Brussels Effect. This determination is key to understand the dynamic of regulatory powers in the world regarding Artificial Intelligence, because this can be an important factor for the Big Tech companies and the regulatory monitoring they have to put into effect from now on, especially taking into account that authorities are going to take special attention to new developments on the field that can pose a high or unacceptable risks to humans.
