Recent advances in artificial intelligence prompt a reexamination of consciousness, personhood, and legal implications. This thesis investigates whether artificial consciousness can be achieved and the potential legal consequences.
Through the lens of computational functionalism, it argues that if AI systems can replicate the functional organization underlying human consciousness, machine consciousness is possible. The work is divided into three chapters: one surveys philosophy of mind and theories of consciousness, another examines levels of AI (ANI, AGI, ASI) and their relationship to consciousness, and the final chapter evaluates legal personhood, rights, duties, liability, and regulation. The thesis concludes with recommendations for companies and governments on addressing these issues.
