Riassunto (Inglese)
The investigation carried out in this thesis aims, first, to identify the patterns of penetration—both current and prospective—of AI-based tools into the dynamics of Italian civil procedure, and in particular into its introductory phase (the reading and analysis of pleadings), in relation to the burden of proof, and into the drafting of the judgment (and therefore in relation to the judge's duty to state the reasons for the decision); and, second, to assess whether, and to what extent, the legislation introduced by the European legislator (the AI Act) and by the domestic legislator (Law 132/2025) is capable, at once, of promoting their application and of countering the associated risks (in particular, the potential compromise of the independence of the judicial body). To support the observations developed in this work, the analysis draws on certain comparative insights (from both European and non-European experiences) regarding the application of algorithmic tools to civil procedure.
