The paper begins with a research question: how has socialism under the rule of law developed in China from 1982 to the present? How has it influenced global governance? Can it represent an alternative to the Western rule of law model? This question was addressed by analyzing China's constitutional history, culminating in the current Constitution, in order to understand how this text was created. The main amendments to the text are then analyzed to trace China's development over the years to the present day. To better understand the latest amendment, introduced in 2018, the rise to power of current President Xi Jinping is also examined, to understand how this event has influenced Chinese political, economic, and legal life. The Chinese rule of law model is then examined, highlighting similarities and differences with both the Western model and similar socialist models. Finally, we come to the topic of governance, observing how the Chinese model has strengthened over time and how it influences the rest of the world, representing today a different model that contrasts with the American-led Washington Consensus model.

Il lavoro parte da una domanda di ricerca: come si è sviluppato il socialismo di diritto in Cina dal 1982 sino ad oggi? Come ha influenzato la governance globale? Può rappresentare un’alternativa al modello di rule of law occidentale? A questa domanda si è cercato di rispondere partendo dall’analisi della storia costituzionale cinese, arrivando all’attuale Costituzione, così da capire come si sia giunti a tale testo. Successivamente sono stati analizzati i principali emendamenti apportati al testo per seguire lo sviluppo cinese nel corso degli anni fino ai giorni nostri. Per comprendere meglio l’ultimo emendamento apportato nel 2018 viene inoltre esaminata l’ascesa al potere dell’attuale presidente Xi Jinping per capire come questo evento abbia influenzato la vita politica, economia e giuridica cinese. In seguito, viene esaminato il modello di rule of law cinese, mettendo in evidenza similitudini e differenze sia con il modello occidentale che con modelli socialisti simili. In conclusione, si arriva al tema della governance, osservando come il modello cinese si sia rafforzato nel tempo e come influenzi il resto del mondo rappresentando ad oggi un modello differente che si contrappone al modello del Washington Consensus a guida americana.
