This research examines the evolution of space law through the perspective of navigation law, assessing whether the legal categories traditionally developed for maritime and aeronautical navigation can serve as the conceptual framework for regulating space activities. The study begins with an analysis of international space law and the Corpus Juris Spatialis, before focusing on Italian Law No. 89 of 13 June 2025, the first comprehensive national legislation on space activities, and the proposed European regulation known as the EU Space Act.
Particular attention is devoted to the comparison between the categories of navigation law and those introduced by space legislation, with specific reference to the space operator, space objects, registration systems, authorization procedures, and liability regimes. The research also addresses the issue of cross-domain critical infrastructures, highlighting the interdependencies between the maritime, space, and digital domains, as well as the role of the Italian golden power mechanism in protecting strategic assets.
The final part of the study analyses the expected effects of the new regulatory framework on space sector operators, evaluating its impact on competitiveness, market access, and the development of the space economy. The thesis concludes that navigation law continues to represent the primary evolutionary matrix of contemporary space law.

La ricerca analizza l’evoluzione del diritto spaziale attraverso la prospettiva del diritto della navigazione, verificando se le categorie tradizionalmente elaborate per la navigazione marittima e aerea possano costituire il modello concettuale di riferimento per la disciplina delle attività spaziali. L’indagine prende le mosse dal diritto internazionale dello spazio e dal Corpus Iuris Spatialis, per poi esaminare la legge 13 giugno 2025, n. 89, prima disciplina organica italiana delle attività spaziali, e la proposta di regolamento europeo denominata EU Space Act.
Particolare attenzione è dedicata al confronto tra le categorie del diritto della navigazione e quelle introdotte dalla normativa spaziale, con riferimento all’operatore spaziale, agli oggetti spaziali, ai registri, ai regimi autorizzatori e alla responsabilità. La ricerca affronta inoltre il tema delle infrastrutture critiche inter-dominio, evidenziando le interdipendenze tra dominio marittimo, spaziale e digitale e il ruolo del golden power nella tutela degli asset strategici.
Nella parte finale vengono analizzati gli effetti attesi della nuova disciplina sugli operatori del settore, valutandone l’impatto sulla competitività, sull’accesso al mercato e sullo sviluppo dell’economia spaziale. La tesi conclude che il diritto della navigazione rappresenta ancora oggi la principale matrice evolutiva del diritto spaziale contemporaneo.
