The purpose of this work is firstly to compare the Italian and German dismissal
protections. Starting from the historical background of the expansive phase of the
regulations that restrict the managerial capacity to dismiss employees, it dwells in
the first chapter on the most recent reforms and how they have affected the
protections in the work relationship. A more in-depth comparison of job security
regulations is conducted in the second chapter, focusing in particular on the
role of german betriebliche Mitbestimmung in the dismissal phase. In the third and
final chapter a comparison of the two social security systems is developed with
exclusive regard to social security and unemployment assistance measures and how
these have been affected by the emergence of the conditionality principle. The latter
is a central element in order to fully analyse the reforms - inspired by the reflection
on flexicurity - of the reduction of protection in the work relationship in order to
improve and enlarge it in the labour market, which in Italy have been implemented,
in particular with regard to protection against unfair dismissal, in a much more
incisive way than in the German system.
