La tesi ha ad oggetto la disciplina della crisi della società in house e si sviluppa secondo tre capitoli. Nel primo capitolo sono definiti i caratteri della società in house, con particolare riferimento ai requisiti dell’in house providing di matrice comunitaria. Nel secondo capitolo vengono delineati i vari orientamenti dottrinali e giurisprudenziali in materia di fallimento di società in house e i riflessi che discendono dal loro assoggettamento alle procedure concorsuali. Infine, nel terzo capitolo è stato approfondito l’istituto dell’esercizio provvisorio per verificare come esso possa essere adottato per garantire la continuità del servizio pubblico offerto dalle società in house.

This dissertation aims at investigating the institute of the crisis of the in house company, by developing a case study divided in three chapters. Chapter 1 defines the characteristics of in house providing within the Italian legislation and the link with the European sentences. In Chapter 2 the most important doctrinal guidance of the insolvency of in house company are illustrated. In particular, Chapter 2 aims at underlining what are the effects of insolvency. Finally, in Chapter 3 there is a focus about the operations on a provisional basis to understand whether the institute may be adopted in order to guarantee the continuity of the public services provided by in house companies
