The thesis examines the principle of the best interests of the child in international, European, and three national legal systems: Italy, the United Kingdom, and the United States.
The analysis begins with the international and European context, focusing on the UN Convention on the Rights of the Child and the Charter of Fundamental Rights of the European Union. It explores how the principle has developed and is applied, particularly for migrant children.
The research looks at how the principle of the best interests of the child is interpreted in different legal systems and how it is included and applied in laws and court decisions, with a special focus on migrant children. Their rights are often seen as less important than the interests related to immigration control and public order.

La tesi esamina il principio dei best interests of the child nel diritto internazionale, europeo e in tre ordinamenti nazionali: Italia, Regno Unito e Stati Uniti.
L’analisi parte dal contesto internazionale ed europeo, con focus sulla Convenzione ONU sui diritti del fanciullo e la Carta dei diritti fondamentali dell’Unione Europea, esplorando come il principio si sviluppi e venga applicato, con particolare attenzione ai minori migranti.
La ricerca esplora come il principio del superiore interesse del minore venga declinato nei vari ordinamenti giuridici, valutando come sia effettivamente integrato e applicato nella giurisprudenza e nella normativa, con focus sulla situazione dei minori migranti, i cui diritti spesso vengono posti in secondo piano rispetto agli interessi legati al controllo dell’immigrazione e all’ordine pubblico.
