This study examines the evolution of the right to health within the Italian legal system, taking the pandemic crisis as a privileged vantage point to analyse the critical issues that emerged in response to such an exceptional event. Adopting a multidisciplinary approach, the study begins with the historical role of infectious diseases, framing their social impact in light of the Economics of Infectious Diseases. The reflection then shifts to Article 32 of the Italian Constitution, whose multidimensional nature is studied considering the specificities of the pandemic experience.
After examining the extensive use of Prime Ministerial Decrees (D.P.C.M.) and the underlying logic of balancing fundamental rights during the pandemic, the study evaluates the operational dimension of the National Health Service (SSN), addressing the ethical implications of triage in contexts of resource scarcity.
Lastly, attention is focused on issues that, despite their relevance, have long remained in the background of institutional debate. Specifically, the study investigates the delicate matters of mental health and eating disorders, treating them as paradigmatic examples of the organisational inefficiencies of the system and the precariousness of the related ministerial funding.
This choice reflects the need to recognize the law as a living instrument, duty-bound to understand the fractures emerging within society to offer adequate forms of protection and to ensure that the right to health is fully realized in actual practice.

Il presente lavoro indaga l’evoluzione del diritto alla salute nell’ordinamento italiano assumendo la crisi pandemica come osservatorio privilegiato per analizzare le criticità emerse dinanzi a un evento dotato di siffatta eccezionalità. Attraverso un approccio multidisciplinare, l’indagine prende le mosse dal ruolo storico delle malattie infettive, inquadrandone l’impatto sociale alla luce della Economics of Infectious Diseases. La riflessione si sposta poi sull’art.32 della Costituzione, la cui natura multidimensionale viene studiata alla luce delle peculiarità dell’esperienza pandemica. Dopo aver analizzato il massiccio ricorso ai D.P.C.M. e le logiche sottese al bilanciamento dei diritti in epoca pandemica, si valuta la dimensione operativa del SSN affrontando le implicazioni etiche del triage in contesti di scarsità di risorse. Da ultimo, l’attenzione si concentra su tematiche che, nonostante la loro rilevanza, sono rimaste a lungo ai margini del dibattito istituzionale. Si indagano, in particolare, le delicate questioni della salute mentale e dei disturbi della nutrizione e dell’alimentazione, assumendoli a paradigma dell’inefficienza organizzativa del sistema e della precarietà dei relativi fondi ministeriali. Tale scelta risponde alla necessità di riconoscere il diritto come uno strumento vivo, tenuto a comprendere le fratture emerse nella società per poter offrire adeguati strumenti di tutela e garantire che il diritto alla salute trovi un pieno riscontro anche nella realtà effettiva.
