Il lavoro svolto in questa tesi si propone l’obiettivo di dare un quadro generale ad una delle figure più controverse della nostra società, il serial killer provando a fornire al lettore un esame che sia il più completo possibile di questa figura.
Il lavoro è diviso in tre capitoli, si potrà notare che il fenomeno relativo all’omicidio seriale è tutt'altro che recente, è quasi impossibile datare la nascita di questa figura, si potrà notare tutto ciò in un excursus storico, una raccolta di casi di omicidio seriale partendo dall’antica Roma arrivando ai giorni nostri.
Guarderemo alle diverse definizioni date dai teorici e dagli esperti del settore, ossia coloro che agiscono sul campo, su chi sia il serial killer, quando un soggetto possa essere definito tale.
Si potranno osservare le differenze che intercorrono tra la fattispecie di omicidio tradizionale e quello seriale riguardanti l'età, il sesso, l'etnia e lo status socio economico di questi ultimi e proveremo a dare un'occhiata ad alcune delle numerose teorie nate negli anni sulla mente criminale, con particolare attenzione al dibattito fra le due più rinomate correnti di pensiero, quella che appoggia l'approccio biologico e quella che appoggia l'approccio sociologico.
Ho voluto dedicare una piccola parentesi all'ingresso delle neuroscienze all'interno del diritto penale, argomento molto delicato e molto controverso al quale in molti hanno provato a dare una risposta, con particolare attenzione a due sentenze una emessa Dalla Corte d'appello di Trieste e un'altra dal tribunale di Como.
Ritornando al fatto che l'omicidio seriale non è un qualcosa di nuovo nella storia dell'umanità, vedremo come nelle varie civiltà veniva trattato, provando a tracciare quello che è stato il percorso normativo nel corso dei secoli partendo dal diritto romano passando per l'illuminismo, per il codice Napoleone, quello del Regno di Sardegna fino all’attuale legislazione.
Daremo una occhiata alla persona del serial killer, a come si comporta il serial killer uomo e la stessa cosa faremo con la controparte donna. Daremo un'occhiata a quali potrebbero essere le motivazioni che portano a questa devianza, provando a guardare nel passato dei serial killer, ai possibili traumi avvenuti nell’infanzia di quest’ultimi, alla particolare ed esuberante sessualità di questi soggetti, alla presenza di parafilie con varie teorie dedicate a questo tema esaminando queste parafilie una per una, vedremo il sadismo, la necrofilia, il feticismo il voyerismo e alla presenza di patologie psichiatriche quali disturbi paranoide dei psicotici e schizofrenici il disturbo borderline.
Vedremo quali sono le vittime preferite dei serial killer distinguendo le motivazioni che portano un serial killer a scegliere una tipologia di vittima piuttosto che un'altra, faremo un esame sulla vittima uomo, la vittima donna, la vittima bambino per poi passare anche all'omicidio seriale di coppie.
Ci occuperemo anche della materia più puramente investigativa vedendo come avviene l'indagine nei casi di reati seriali, partendo dal sopralluogo, punto di partenza dell'indagine.
Parleremo del Criminal profiling, come nasce, come deve essere creato e che utilità apporta questa tecnica all'interno delle indagini.
Vedremo come si muovono gli organi di polizia e come procedono alla ricerca del serial killer.
Parleremo del rapporto informativo e del profilo geografico, due tappe importantissime per poter procedere all'indagine.
Proseguiremo poi con le tecniche di abbordaggio predilette dai serial killer, come fanno quindi ad avvicinare e ad adescare le vittime. Vedremo come si comporta il nostro sistema penale di fronte a questi soggetti quali siano le pene previste per questi soggetti e affronteremo il delicato discorso collegato all'immutabilità di quest'ultimo, Come si classifica la capacità di intendere e di volere, cosa importantissima per poter considerare imputabile un soggetto col collegamento a questo passeremo alla perizia psichiatrica, vedremo quanto pesi quest'ultima all'interno del processo virgo faremo una piccola comparazione con Regno Unito e Stati Uniti proprio per quanto riguarda l'imputabilità, andando avanti vedremo la figura del reato continuato spesso usata dai criminali autori di omicidi seriali per poter ottenere un trattamento sanzionatorio più favorevole, vedremo la confessione e che cosa rappresenta quest'ultimo per un pluriomicida e concluderemo discorso con la pena per l'omicidio seriale, il trattamento e la prevenzione per quest'ultimo.

The work carried out in this thesis aims to give a general picture of one of the most controversial figures in our society, the serial killer, trying to provide the reader with an examination of this figure that is as complete as possible.
The work is divided into three chapters, it will be possible to notice that the phenomenon relating to serial murder is anything but recent, it is almost impossible to date the birth of this figure, it will be possible to notice all this in a historical excursus, a collection of cases of serial murder starting from ancient Rome up to the present day.
We will look at the different definitions given by theorists and experts in the sector, i.e. those who work in the field, on who the serial killer is and when a subject can be defined as such.
It will be possible to observe the differences that exist between the case of traditional homicide and serial homicide regarding the age, sex, ethnicity and socio-economic status of the latter and we will try to take a look at some of the numerous theories born over the years on the criminal mind, with particular attention to the debate between the two most renowned currents of thought, the one that supports the biological approach and the one that supports the sociological approach.
I wanted to dedicate a small parenthesis to the entry of neuroscience into criminal law, a very delicate and very controversial topic to which many have tried to give an answer, with particular attention to two sentences, one issued by the Court of Appeal of Trieste and another from the Como court.
Returning to the fact that serial murder is not something new in the history of humanity, we will see how it was treated in various civilizations, trying to trace what has been the regulatory path over the centuries starting from Roman law through enlightenment, for the Napoleonic code, that of the Kingdom of Sardinia up to the current legislation.
We will take a look at the person of the serial killer, how the male serial killer behaves and we will do the same thing with the female counterpart. We will take a look at what could be the reasons that lead to this deviance, trying to look into the past of serial killers, at the possible traumas that occurred in the latter's childhood, at the particular and exuberant sexuality of these subjects, at the presence of paraphilias with various theories dedicated to this theme examining these paraphilias one by one, we will see sadism, necrophilia, fetishism, voyeurism and the presence of psychiatric pathologies such as paranoid disorders of psychotics and schizophrenics, borderline disorder.
We will see which serial killers' favorite victims are, distinguishing the reasons that lead a serial killer to choose one type of victim rather than another, we will examine the male victim, the female victim, the child victim and then also move on to murder serial of couples.
We will also deal with more purely investigative matters by seeing how the investigation takes place in cases of serial crimes, starting from the inspection, the starting point of the investigation.
We will talk about criminal profiling, how it was born, how it must be created and what usefulness this technique brings to investigations.
We will see how the police move and how they proceed in the search for the serial killer.
We will talk about the information report and the geographical profile, two very important stages in order to proceed with the investigation.
We will then continue with the boarding techniques favored by serial killers, how they approach and lure the victims. We will see how our penal system behaves towards these subjects, what are the penalties foreseen for these subjects and we will address the delicate issue connected to the immutability of the latter. How is the capacity to understand and will be classified, which is very important in order to be able to consider a subject attributable with the connection to this we will move on to the psychiatric assessment, we will see how much the latter weighs within the virgo process we will make a small comparison with the United Kingdom and the United States precisely with regard to imputability, moving forward we will see the figure of the crime continued often used by criminals who commit serial murders in order to obtain more favorable sanctioning treatment, we will see the confession and what the latter represents for a multiple murderer and we will conclude the discussion with the punishment for serial murder, the treatment and prevention for this.
