RIASSUNTO
L’elaborato parte da un inquadramento storiografico del processo civile in Italia dal 1861 ad oggi, trattando le riforme e le ideologie affermatesi per poi destinare una parte del discorso sul codice processuale civile.
In seguito, viene analizzato l’atto nei suoi requisiti di forma, elementi e il modello legale, con un appunto sulla previsione di elementi estrinseci e intrinseci per la sua validità ed efficacia e sono fondamentali anche i principi di legalità, equipollenza e strumentalità delle forme.
Dopo di questo è importante il vizio e la pronuncia di nullità e ulteriormente la rilevazione del vizio, la sanabilità e la rinnovazione dell’atto viziato.
La previsione di altre forme invalidanti previste, o solo la nullità. In ultimo, vengono riportate le pronunce della dottrina e della giurisprudenza sul tema.

SUMMARY

The paper commences from a historiographical grade of the civil trial in Italy from 1861 through to the present day, dealing with stating reforms and ideologies before discussing the civil procedural code.

Subsequently, we will analyse the process in it’s formal requirements, elements and legal form also referring to the estimation of extrinsic and intrinsic elements for his value and effectiveness. The principles of legality, equivalence and instrumentality of forms are also fundamental.

Thereafter it is important the vice and the decision of nullify and further the vice detection, the treat-ability and the renewal of the vitiated act.

The estimation of other expected invalidating forms, or just the nullity as a last resort, some judgments pronounced by the doctrine and law about the topic have been reported.
