Summary
Il presente lavoro propone uno studio del fenomeno del commercio elettronico, la sua origine e il suo esponenziale sviluppo durante il periodo di emergenza sanitaria Covid-19. Si analizzano, quindi, alcuni profili relativi alla disciplina dell'e-Commerce e alle conseguenze patologiche registrate nel mercato digitale, quali le pratiche commerciali scorrette e lo scorretto utilizzo dei dati personali. In ultima analisi si evidenzia la possibilità di tutela dell'e-consumer, il contraente debole del rapporto contrattuale, specificandone gli strumenti a disposizione predisposti dalle normative nazionali, quali il diritto di recesso e l'utilizzo delle piattaforme di ADR e ODR.
The following analysis proposes a study of the phenomenon of e-commerce, its origin and its exponential development in the period of Covid-19 health emergency. Some profiles disciplining it are taken in consideration, and the pathological consequences recorded in the digital market are then elaborated, such as the unfair commercial practices and improper use of personal data. In the end, are analyzed the tools which are protecting the e-consumer, a weak contractor in this relationship, specifying those available issued by national regulations, such as the right of withdrawal and the use of ADR and ODR platforms.
