Rivoluzione digitale ha inciso sulle categorie giuridiche tradizionali. Con la digitalizzazione dei dati e l’aumento dei rapporti telematici come abituale mezzo di espressione della persona si assiste alla nascita e all’aumento dei canali d’accesso all’informazione che hanno modificato le modalità di comunicazione, e di conseguenza, i comportamenti delle persone. Se, da una parte, la crescita della rete rappresenta un’opportunità per rafforzare la libertà dell’individuo, dall’altra, laddove questa libertà non fosse regolata, si potrebbe favorire uno scenario caratterizzato da condotte illecite e da ulteriori margini di impunità per gli autori. La società postmoderna ha visto una forte contrapposizione tra le varie accezione della privacy e la libertà di informazione e di comunicazione. Assume un particolare interesse la figura dei minori di età, soggetti particolarmente attivi nella Rete, ma possibili destinatari di effetti devastanti. Per tale motivo, il regolamento europeo sulla privacy 2016/679 sembra muoversi dettando, tra le varie novità, una disciplina dedicata al trattamento dei dati personali del minore d’età. L’indagine si focalizzerà sugli aspetti giuridici della tecnologia dell’informazione ai fini della tutela dei diritti, in maniera specifica di quella categoria di soggetti che sono i minori d’età: esaminandone tutti gli aspetti rilevanti, tra cui la veste di navigatore attivo e passivo.

Digital revolution has affected traditional legal categories. With the digitization of data and the increase in telematic relationships as the usual means of expression of the person, we witness the birth and increase of the channels of access to information that have changed the communication methods, and consequently, the behavior of the people. If, on the one hand, the growth of the network represents an opportunity to strengthen the freedom of the individual, on the other, if this freedom is not regulated, a scenario characterized by illicit conduct and by further margins of impunity for the authors.
Postmodern society has seen a strong contrast between the various meanings of privacy and the freedom of information and communication. Particularly interesting is the figure of minors, individuals who are particularly active on the Net, but who are the potential recipients of devastating effects. For this reason, the European privacy regulation 2016/679 seems to move by dictating, among the various innovations, a discipline dedicated to the processing of personal data of minors. The investigation will focus on the legal aspects of information technology for the purpose of protecting rights, specifically of that category of subjects who are minors: examining all the relevant aspects, including the role of active navigator and passive.
