Lo scritto si propone di analizzare il funzionamento di una delle massime istituzioni a livello globale, il World Trade Organization (WTO), focalizzandosi specificamente sull'attività del suo organo più importante, il Dispute Settlement Body (DSB), deputato a risolvere le controversie di carattere commerciale tra Stati membri.
Successivamente verranno prese in esame le principali forme di concorrenza sleale nel commercio tra Stati, con un focus sul caso cinese e le reazioni occidentali, anche in ottica di antefatto dell’attuale rapporto tra le due maggiori potenze economiche mondiali. Si esamineranno poi nel dettaglio le cause dell’attuale paralisi dell’organo di appello interno al Dispute Settlement Body, con particolare attenzione sulla crisi Sino-Americana e le sue ripercussioni sul commercio globale.
Nella parte finale, l’elaborato ricostruisce il dibattito dottrinale circa cause e conseguenze della crisi del sistema multilaterale di accordi e del WTO stesso, nonché futuri scenari sul suo destino e su nuovi istituti di regolazione del commercio internazionale.


The essay aims to analyze the functioning of one of the highest global institutions, the World Trade Organization, focusing specifically on the activity of its most important body, the Dispute Settlement Body (DSB)Member of the Commission. Subsequently, the main forms of unfair competition in trade between States will be examined, with a focus on the Chinese case and Western reactions, also in view of the background to the current relationship between the two major world economic powers. It will then examine the causes of the current paralysis of the appeal body within the DSB, with particular attention to the Sino-American crisis and its consequences on global trade. in the final part, the essay reconstructs the doctrinal debate on the causes and consequences of the crisis of the multilateral system of agreements and the WTO itself, as well as future scenarios on its fate and on new institutes of regulation of international trade.
