Con il presente elaborato si intende analizzare, in un'ottica comparatistica, la maternità surrogata effettuando uno studio riguardante la regolamentazione del fenomeno in stati europei ed extraeuropei. In particolare si analizzano: l'approccio dei giudici nazionali e sovranazionali alla materia, la redazione e trascrizione degli atti di nascita e la tutela del best interest del minore quando questo venga generato a seguito di surrogazione.

This thesis aim to analyze surrogacy in a comparative perspective, through a study concerning its regulation in European and non-European countries.
In particular, the analysis is focused on the approach of national and supranational judges to the topic, the birth records and their transcrption and the protection of the best interest of the child.
