In questa tesi ho affrontato il tema dell’espropriazione per pubblica utilità quale procedura ordinaria per la pubblica amministrazione ai fini dell’acquisizione di un bene immobile altrui attraverso una breve panoramica delle fasi principali del procedimento stesso.
Nel secondo capitolo ho affrontato il tema delle occupazioni illegittime, facendo un excursus delle stesse partendo dalle occupazioni appropriate e usurpative fino ad arrivare alla disciplina ex art. 42 bis del d.P.R. 327/2001.
Nel terzo capitolo, ho esposto i possibili rimedi alternativi all’art. 42 bis, quali l’usucapione pubblica, la rinuncia abdicativa, l’accordo transattivo e la restituzione del bene al proprietario.
In this work I dealt with the issue of expropriation for public utility as an ordinary procedure for the public administration for the purpose of acquiring someone else's property through a brief of the main phases of the procedure itself.
In the second chapter I dealt with the issue of illegitimate occupations, making an excursus of the same starting from the appropriate and usurpative occupations up to the discipline pursuant to art. 42 bis d.P.R.327/2001.
In the third chapter, I exposed the possible alternative remedies to art. 42 bis, such as the public usucapione, the abdication waiver, the settlement agreement and the restitution of the property to the owner.
